TERMS AND CONDITIONS

The following terms and conditions represent the service and sales contract between DITMAR-DESIGN STUDIO and persons who order design services.

Please carefully read and understand these terms and conditions before placing any order.

GENERAL

1. You must be at least 18 years of age, or such other age of legal majority in your jurisdiction, to order services from DITMAR-DESIGN STUDIO because you must be old enough to enter into contracts in your own name as well as acquire or view adult graphics and images.

2. You are retaining the services of DITMAR-DESIGN STUDIO, and DITMAR-DESIGN STUDIO provides those services, as an independent contractor.

3. DITMAR-DESIGN STUDIO does not require any advance payment or deposit for design service orders. The maximum delay of payment after full customer's approval is 5 days.

4. We accept only ePassporte and WebMoney online payments now.

5. Under no circumstances will DITMAR-DESIGN STUDIO be liable for any direct, indirect, incidental, consequential or punitive damages resulting from your use of the design services, except for claims which may arise from DITMAR-DESIGN STUDIO infringement of a third party's intellectual property rights in connection with design components created or secured by DITMAR-DESIGN STUDIO. To the extent that you supply DITMAR-DESIGN STUDIO with any design elements, you agree to indemnify and hold harmless DITMAR-DESIGN STUDIO from and against any claim, loss or damage, including its reasonable attorneys' fees, resulting from the use of such design element. You further agree to indemnify and hold harmless DITMAR-DESIGN STUDIO from and against any claim, loss or damage, including its reasonable attorneys fees, resulting from the content or intellectual property appearing in, on or through your website or linked websites.

6. You represent and warrant that all models appearing in any image appearing in, on or through your website, or in any image supplied by you to DITMAR-DESIGN STUDIO are eighteen years of age or older at the time of image creation, and that you are in compliance with Title 18 Section 2257 regarding such images.

HOW IT WORKS?

1. Upon completion of your design, you will be sent a sample URL on our servers of your final design for approval. For HTML sites, sampled screenshoots will be placed in your special directory. We do not ask that you send in the balance of your payment until you are satisfied with the samples provide to you. Then we will send your finished and fully-functional files by e-mail or by any other method you prefer.

2. We do not deliver the .PSD files. You are buying a finished product. However, if you ever need some minor changes to be done after, ask us, we will gladly make them for you free of charges, this is part of our after-sales customer's service.
